These general conditions apply to all purchases made through the website www.swineup.com; through the site, it will be possible to purchase all products offered for sale, subject to actual warehouse availability.

2. Subject Matter

These general conditions regulate the purchase procedure of products by the user, through the guided procedure present within the "Shop" section of the site. The user may view this contractual regulation at any time by selecting the appropriate "Terms and Conditions" link available in every section of the site. The purchase procedure may be used by a consumer (B2C) or by a professional (B2B); in the event that the purchase is made by a consumer, in addition to these general conditions and the provisions of the Civil Code on the matter, the provisions of the Consumer Code (Legislative Decree no. 206/2005) will also apply. In the case of a purchase made by a company, the data for B2B invoicing must be provided and the consumer code will not apply.

3. Purchase Procedure

To proceed with the purchase of a product, the user must connect to the website www.swineup.com and enter the section dedicated to the "Shop". The user may then select the chosen product and add it to the cart; once added to the cart, the user may select additional products, or complete the purchase procedure by selecting the "Proceed to checkout" link. At checkout, the user will be asked whether they wish to access their "reserved area" or complete the purchase as a "guest"; at any time, the user may choose whether to register on the website, understanding that this is an optional procedure for the purpose of purchasing products on the site. In the event that access occurs as a "guest", solely for the purposes of the selected sales procedure, the user will be asked to enter their name, surname and email address. Subsequently, the user may complete the order by first inserting the appropriate flag in relation to acceptance of these sales conditions, onerous clauses and acknowledgment of the privacy policy (mandatory for the positive completion of the procedure); the user may choose whether or not to receive the newsletter from the supplier by selecting the appropriate flag. Finally, it will be requested to indicate whether the professional user belongs to the Ho.Re.Ca. category, with the obligation to attach (if affirmative) the chamber of commerce certificate; in this case, the account will be validated manually by the supplier, after uploading the chamber of commerce certificate and verification that it is indeed a Ho.Re.Ca. user. After this verification, it will be possible to continue with the sales procedure by the user. After choosing the preferred payment methods (see art. 4) and the preferred shipping methods (see art. 5), the user may confirm that they wish to purchase the chosen products by selecting the "send order" link. The sales contract must be considered concluded pursuant to law only when the user receives the subsequent order confirmation email from the supplier, subject to the provisions of art. 4 for the case of payment by bank transfer. The mere presence of products within the site and the purchase procedure followed by the user do not guarantee the actual warehouse availability of the chosen products; availability and therefore the sale will be confirmed only with receipt of the order confirmation email sent by the supplier to the user.

4. Price and Payments

The price of products is indicated, for each product, net of VAT and shipping costs. The indication of the applied VAT and shipping costs will be provided to the user when choosing to proceed with checkout, and will be indicated separately from the price of the selected product; the total cost of the product will also be specified, resulting from the sum of the amounts indicated above. Payment for purchased services may be made by payment card, PayPal and bank transfer. The purchase procedure via payment card or PayPal may be considered definitively concluded only with the order confirmation communication, which will also certify successful payment. In the case of payment by bank transfer, the order may be considered confirmed only following the actual crediting of the amounts to the supplier's account; only from that moment will the shipping terms referred to in art. 5 begin.

5. Shipping Methods

The products will be shipped by courier, to the address indicated by the user, who assumes all responsibility regarding the correctness of the data provided. Shipping costs are specified at the time of the checkout procedure. Delivery of products is guaranteed within five working days from order confirmation or, in the case of payment by bank transfer, from the crediting of the amounts to the supplier's account. Force majeure cases, not attributable to the supplier, are excepted for non-shipment or delays in receiving products.

6. Right of Withdrawal

If the purchase is made by a consumer (B2C), pursuant to articles 52 et seq. of Legislative Decree no. 206/2005, the right of withdrawal is admitted within the period of fourteen days from the date on which the consumer or a third party designated by them takes possession of the purchased product. Withdrawal may be exercised by sending the form available at the following link Standard Withdrawal Form, duly completed and signed, to the supplier's email address info@swineup.com, or by sending a communication with which the consumer explicitly declares their wish to withdraw, to the supplier's contact details. Within fourteen days from the date on which the supplier receives the withdrawal communication, the consumer will be reimbursed for the costs incurred for the purchase of the product, including shipping costs, using the same methods with which payment was made or with other and different methods, expressly agreed with the supplier. The reimbursement may be withheld by the supplier until the consumer has provided proof of having returned the product or, in case of lack of proof, until the product is returned. The consumer must return the product, using the methods indicated in the previous period, within fourteen days from the date on which they exercised withdrawal; only the costs of returning the goods are borne by the consumer. It is understood that, if the goods are damaged as a result of post-return checks, the supplier reserves all appropriate action to protect their rights and interests against the consumer.

7. Invoicing

Before completing the order, the consumer/professional must provide their invoicing data, assuming any and all responsibility regarding the correctness and truthfulness of the same.

8. Warranty

The supplier guarantees to the consumer that the purchased products are in conformity with the description contained within the site and with the type of product chosen, pursuant to articles 128 et seq. of Legislative Decree no. 206/2005. Furthermore, the provisions of the civil code regarding the sale of goods pursuant to articles 1490 et seq. apply; in this regard, should the delivered product prove to be defective and/or damaged, as a partial derogation from the provisions of article 1495 of the Civil Code, the parties agree that it is the consumer's burden, under penalty of forfeiture, to report such defects within three days of delivery. It is understood that the supplier reserves all appropriate verification regarding the reporting of defects/faults and the actual correspondence to the truth. In case of late reporting, the user cannot in any way activate the warranty provided by articles 1490 et seq. of the civil code, nor take action in any way against the supplier.

9. Competent Court

For any dispute relating to the validity, interpretation or execution of this contract, the consumer's court is exclusively competent in the case of purchase by a private individual for purposes not related to their commercial activity; in the case of a purchase concluded by a professional, within the scope of their commercial activity, the Court of Padua is exclusively competent.

Pursuant to the effects of articles 1341 and 1342 of the Civil Code, the user declares to have read, understood and specifically approve the following clauses:
